Not every hour worked by an apprentice counts toward the Inflation Reduction Act's (IRA) 15% apprentice labor-hour requirement. If hours are disqualified, the apprentice must be paid the full journeyman wage and your project could face penalties of $50 to $500 per noncompliant hour. Here are the six situations where apprentice hours don't count.

Unregistered Apprentices

Only apprentices formally registered in a U.S. DOL-approved program can be counted. Unregistered workers—even if called “apprentices”—do not qualify.

Unsupervised Work (1:1 Ratio Violations)

The IRA requires a 1:1 apprentice-to-journeyman ratio (unless your program standards say otherwise). If apprentices work without a journeyman onsite, their hours don’t count.

Ratio Violations With Multiple Apprentices

Example: 3 apprentices and 1 journeyman onsite. The extra 2 apprentices must be paid at journeyman rates, and their hours don’t count toward the 15% requirement.

Out-of-Scope Work

Apprentice hours only count if they are performing tasks within their registered occupation standards. Hours doing unrelated work may not qualify.

Apprentices Not on W-2 Payroll

Apprentices must be W-2 employees. Hours worked by 1099 workers or laborers who haven’t been converted into registered apprentices don’t count.

Canceled or Inactive Apprentice Registrations

If an apprentice’s registration is suspended, canceled, or inactive, their hours logged after that status change are not valid.

No. For the hours where an apprentice meets the ratio requirements and was supervised by a journeyman, those hours count. Any unsupervised hours don't count as apprentice labor hours because the unsupervised apprentice must be paid a journeyman's wage.

Do overtime hours count towards apprenticeship requirements?

Yes, overtime hour count towards apprenticeship requirements as long as the apprentice was supervised by a journeyworker in that same occupation during those hours.

How many hours should an apprentice work per week?

An apprentice can work as many hours as you'd like, but in order for those hours to be counted towards the IRA's apprentice utilization rate, the hours must be supervised by a journeyworker.

Do apprenticeship hours expire?

No, there is no such thing as an apprentice's hours that expire. That said, the hours they work should be tracked each payroll period in Apprentix.

What happens if I don't meet the 15% apprentice labor hour requirement?

This is a contractual issue between you and your client. The 15% apprentice labor hour requirement is technically across the entire project, not per contractor. This means it's possible that another contractor may have exceeded the 15% requirement and could be able to make up for any hours you were deficient. You'd need to speak to your client (the Prime contractor) since this is a contractual issue and not one that Apprentix can help with.
